When modal form is opened nothing in menu is selectable

When modal form is opened nothing in menu is selectable

So, I downloaded the CommandBars library a few days ago and put the menu on _SCREEN. It works as expected except when I open a modal form. The menu is still accesible but if I select something nothing happens.
And also how do I set the menu so it has a gripper but is fixed on top of the _SCREEN and is not movable?
